I get what you mean when you mention Windows Vista and all. I'm on XP for that matter; killed background processes as far as possible, and the observation is - generally playable except for the abovefore described "1st battle phenomenom". So I was speculating it's not that much of a frame-rate problem throughout than it is data overflow at certain loading points.
Based solely on presumptions: say, if the company's policy is to disallow the caching of sound files, and providing a buffer sequence for loading completion doesn't run well with the gaming experience, then perhaps providing the user option to decline all sound streaming would be good to begin experimentation with (if muting doesn't already prevent so)?
p/s Actually why would a buffer sequence like "synchronising for combat" not be good for basic adoption? I also wanted to suggest other stuffs like hotkeys for pouch and equipment set toggling to work around graphical switching; confirmation popup for shop items that cannot be equipped, etc.
